US ITC Judge Finds Glas Infringed Two JUUL Vape Patents, Recommends Restrictions on Related Imports——Glas Received FDA Marketing Authorization for Four Vape Pods in May 2026; Proposed Restrictions Remain Under Commission Review
A U.S. International Trade Commission (USITC) administrative law judge issued an initial determination on October 20, 2026, finding that certain Glas vaping devices, cartridges and components infringed 12 claims across two patents asserted by JUUL, constituting a violation of Section 337 of the Tariff Act of 1930. The judge recommended a limited exclusion order and a cease and desist order against the Glas respondents. Five months earlier, the FDA authorized four Glas e-cigarette pods, including mango, blueberry and two menthol variants. The patent investigation concerns device and cartridge structures and is separate from FDA premarket review. The proposed import restrictions have not become final, and their product-level scope remains unresolved.

Key Points

  • A USITC administrative law judge found infringement of 12 claims across two patents asserted by JUUL, while five other claims were not shown to be infringed.
  • The judge recommended a limited exclusion order and a cease and desist order against Glas, subject to further Commission proceedings.
  • The FDA granted marketing authorization to four Glas pods on May 5, 2026, each containing 1.2 mL of e-liquid with a nicotine concentration of 50 mg/mL.
  • The patents concern vaporizer device and cartridge structures. The public record does not establish the complete overlap between FDA-authorized products and the proposed import restrictions.

A U.S. International Trade Commission (USITC) administrative law judge issued an initial determination on October 20 finding that certain vaping devices, cartridges and components associated with Glas infringed 12 claims across two patents asserted by JUUL, constituting a violation of Section 337 of the Tariff Act of 1930. The judge also recommended a limited exclusion order and a cease and desist order against the Glas respondents, subject to further Commission review.

The ruling concerns Investigation No. 337-TA-1464, brought by JUUL Labs, Inc. and VMR Products LLC against Glas, Inc. and Glas, LLC.

Administrative Law Judge Doris Johnson Hines determined that the importation and post-importation sale of certain vaporizer products involved patent infringement.

The ruling came approximately five months after the U.S. Food and Drug Administration (FDA) granted marketing authorization to four Glas e-cigarette pods, including mango, blueberry and two menthol variants. The patent investigation is separate from the FDA's premarket tobacco product review process.

Judge Finds Infringement of Two JUUL-Asserted Patents, Recommends Import Restrictions

JUUL Labs and VMR Products filed their Section 337 complaint with the USITC on September 30, 2025, alleging that Glas vaporizer devices, cartridges and related components infringed their asserted U.S. patent rights.

The Commission voted to institute the investigation on December 16, 2025, with the notice published in the Federal Register on December 19.

The complaint therefore preceded the FDA's May 2026 authorization of four additional Glas e-cigarette pods.

The two patents at issue are U.S. Patent Nos. 11,134,722 and 11,606,981, both titled Vaporizer.

According to the October 20 public notice of initial determination, the judge found that claims 1, 5, 7, 15–16 and 18–21 of Patent No. 11,134,722 were infringed, while infringement of claims 6 and 17 was not established.

For Patent No. 11,606,981, the judge found infringement of claims 1, 5 and 8, but not claims 9–10 and 18.

In total, the judge found infringement of 12 patent claims, while five other claims were not shown to be infringed.

The judge also determined that Glas had not shown the relevant claims identified in the notice to be invalid and that both patents satisfied the technical prong of the domestic industry requirement under Section 337.

The economic prong of the domestic industry requirement had been considered separately. On May 27, 2026, the administrative law judge granted JUUL's unopposed motion for summary determination on that issue. The Commission subsequently announced on June 17 that it had extended the deadline for deciding whether to review that determination to July 9.

The patents concern structural arrangements involving vaporizer devices and replaceable cartridges, including cartridge-receiving chambers, heating and liquid-delivery components, inhalation passages, electrical contacts and magnetic connections.

Public patent records trace the relevant inventions to priority filings dating back to 2013.

The two-page public notice identifies the claims found infringed but does not provide a complete technical comparison between Glas's accused products and the asserted patent claims.

In a notice published in the Federal Register on October 27, the USITC disclosed that the administrative law judge had recommended a limited exclusion order directed at Glas, Inc. and Glas, LLC.

The proposed order would cover vaporizer devices, cartridges and related components imported, sold for importation or sold after importation by the respondents that infringe specified claims of the two patents.

The judge also recommended a cease and desist order restricting certain commercial activities involving infringing imported products.

The recommendations have not become final Commission orders.

Glas Received FDA Authorization for Four Pods in May, With Age Verification and Anti-Counterfeiting Features

On May 5, 2026, the FDA granted marketing authorization to four Glas e-cigarette pods through the premarket tobacco product application (PMTA) pathway.

The products were Classic Menthol, Fresh Menthol, Gold and Sapphire. Gold is mango-flavored, Sapphire is blueberry-flavored, and the other two are menthol variants.

FDA review documents show that each pod contains 1.2 mL of e-liquid with a nicotine concentration of 50 mg/mL, or 5%, using tobacco-derived nicotine.

The FDA said the decision marked its first authorization of electronic nicotine delivery system (ENDS) products with flavors other than tobacco or menthol.

The four pods are part of the Glas G² product system. The FDA had previously authorized the G² rechargeable device and its Blonde Tobacco pod.

The Glas G² device uses a smartphone-based access restriction system requiring age and identity verification through government-issued identification, followed by Bluetooth pairing.

The associated app also conducts periodic biometric checks to verify the user's identity.

According to the FDA's technical review, the device is designed to operate within wireless communication range of the verified smartphone. If the connection is lost, a proximity grace period of approximately one hour applies before the device automatically locks.

The G² system also incorporates encrypted pod authentication and anti-counterfeiting technology. It is designed to operate only with authenticated Glas pods, restricting the use of unauthorized cartridges and refilled products.

The FDA concluded that the access restriction technology, combined with marketing restrictions, was expected to effectively mitigate the likelihood of youth use.

FDA marketing authorization applies to specified products and does not constitute a license to use third-party patents.

The publicly available USITC initial determination does not identify, on a product-by-product basis, which FDA-authorized Glas devices and pods fall within the proposed exclusion order.

Import Restrictions Await Commission Review; Product Scope and Market Impact Remain Uncertain

A Federal Register notice published on October 27, 2026, shows that the USITC is seeking public interest submissions concerning the import exclusion and cease and desist remedies recommended by the administrative law judge.

The Commission is requesting information about the potential effects of those measures on U.S. public health and welfare, competition, domestic production of comparable products and consumers.

It is also asking whether alternative products could replace the affected imports and whether JUUL, its licensees or other suppliers could meet the relevant demand within a commercially reasonable period.

The deadline for submissions from the public and interested government agencies is November 19, 2026.

As of November 4, public searches had not identified a final exclusion order or cease and desist order issued by the Commission in this investigation.

JUUL Labs and VMR Products have secured a favorable initial patent infringement determination, but whether Glas will ultimately face import restrictions, which specific products would be covered and how its U.S. supply and sales operations might be affected remain subject to further proceedings.

The case involves two separate U.S. market access frameworks. The FDA evaluates whether marketing a tobacco product meets the applicable public health standard, while the USITC may investigate whether imported products infringe U.S. intellectual property rights and impose trade remedies when statutory requirements are met.

Glas's earlier FDA marketing authorizations do not prevent its products from facing separate import or commercial restrictions based on third-party patent rights.

Germany collected €9.789 billion in total tobacco tax revenue from January through August 2026, down 10.8% from a year earlier, according to the Federal Ministry of Finance. Germany's tobacco tax base covers not only cigarettes and fine-cut tobacco but also heated tobacco and vaping liquids taxed as tobacco substitutes. The German Association of the Tobacco Industry and Novel Products, or BVTE, citing federal statistical data, said tax-paid cigarette volume fell 12.6% to 40.6 billion sticks. BVTE is using the latest figures to argue against further tax increases planned from 2027 through 2030, while Germany's parliament is scheduled to hold a first reading of the bill on September 24.
