Spain to Tighten E-Cigarette Regulation: Public-Place Ban, Advertising Limits, Flavour Controls

2Firsts, 21 October 2025 — According to Docon Time, Spain’s proposed 2025 Anti-Tobacco Law (now under legislative review) would, for the first time, bring e-cigarettes under the same regulatory framework as traditional tobacco. The shift is described as a turning point with significant implications for consumers and online retailers.

 

The report says the bill’s priorities include banning smoking or vaping in areas such as outdoor café terraces, bus shelters, university campuses, public swimming pools, work vehicles, and the surroundings of schools and hospitals. It would also prohibit sales and supply to minors and, for the first time, explicitly ban consumption by minors.

 

On commerce and marketing, the bill would tighten controls on advertising and visibility: promoting related products at events, in media or on urban public facilities would be prohibited, and flavours or designs likely to attract young people would be restricted. Regulators are also considering the progressive withdrawal of disposable e-cigarettes, citing environmental concerns and ease of access—though the draft text envisages a prohibition on their sale and supply with a 12-month transition period.

 

The report adds that as conventional vaping faces stricter oversight, nicotine-free aerosol products containing natural cannabinoids are on the rise in Spain, including CBG (cannabigerol), CBN (cannabinol) and the newer 10-OH-HHC. Some local vendors are launching bundled offerings (such as CBD packaged in “tobacco-style” pouches) and emphasising compliance and sustainability positioning.
