Legislature Hearing Demanded to Ban Menthol Cigarettes in NYC
New York City social justice and health groups demand a hearing on Intro 577, legislation to end the sale of menthol cigarettes in the city.

According to a report by Readme, a New York City advocacy group for social justice and health has demanded that the City Council hold a public hearing on Intro 577 legislation. This legislation aims to ban the sale of menthol cigarettes in the city.

Despite the support of half of the city council members and civil rights leaders, Intro 577 has yet to undergo a public hearing after more than a year of waiting. Council Member Lynn Schulman, chair of the Health Committee, is the initiator of this bill. Last week, Senator Gillibrand also expressed support for the federal ban on the sale of menthol cigarettes.

Tabitha Ellis, Chairwoman of the Advocacy Committee of the American Heart Association in New York City, has called for the removal of mint-flavored tobacco products from the market. Mint flavoring has been found to make smoking easier to start and harder to quit. Each year, without legislation to end the sale of mint-flavored cigarettes in New York City, thousands of new teenagers, predominantly from minority communities, will begin smoking and develop nicotine addiction through mint-flavored products. For decades, major tobacco companies have aggressively marketed mint-flavored tobacco products in minority communities, but we can now tackle this issue through effective legislation.

Iowa Enforces Vape Registry Law as Retailers Warn Product Limits Could Increase Store Pressure
Iowa has begun enforcing its vape registry law, requiring vape products to be registered before they can be legally sold in the state. The move follows a decision by the U.S. Court of Appeals for the Eighth Circuit to lift an injunction that had blocked enforcement. Retailers have warned that tighter product availability rules could increase pressure on vape shops. One Iowa retailer said that if only a limited number of products remain available, many stores could face significant business challenges.

South Korea Constitutional Court Upholds Volume-Based E-Liquid Tax, With Challenged Rates at KRW 370 and KRW 628 per Milliliter
South Korea's Constitutional Court has upheld fixed taxes on nicotine-containing e-cigarette liquids based on solution volume, ruling that challenged provisions imposing KRW 370 per milliliter in individual consumption tax and KRW 628 per milliliter in tobacco consumption tax do not violate the Constitution. The cases stemmed from historical disputes involving importers that reported nicotine as being extracted from tobacco stems rather than leaves. South Korea has since broadened its tobacco definition to include synthetic nicotine, while current tax laws provide reduced rates for certain products not derived from tobacco.

Smoore Seeks to Toss CCELL Price-Fixing Claim as Court Weighs Vertical Distribution Versus Horizontal Conspiracy
Smoore and four authorized U.S. CCELL distributors are asking a California federal court to permanently dismiss a core antitrust claim brought by direct purchasers. Plaintiffs allege that Smoore coordinated minimum wholesale prices, customer allocation and limits on price competition among distributors, amounting to a per se unlawful horizontal conspiracy. The defendants say the alleged conduct reflects ordinary vertical relationships between a manufacturer and its distributors. The court previously dismissed a similar claim, and the latest dispute centers on whether the second amended complaint adds sufficient facts to establish a horizontal agreement.
