According to infobae., Spain’s Congress Health Committee has approved a non-binding motion calling for the sale of vapes, nicotine pouches, and related products to be restricted to regulated authorized channels, while excluding internet sales and non-specialized stores and reinforcing controls to protect minors and young people.
Committee approved motion to limit sales channels
The motion was introduced by the Socialist Parliamentary Group with the objective of preventing vape use. It was approved in the terms of a negotiated text agreed with the Popular Party, by 33 votes in favor, 2 against, and 1 abstention.
Socialist lawmaker Carmen Andrés Añón said that smoking and vaping are personal decisions, but tobacco use is a public health issue and that public authorities have a constitutional duty to protect it. She also said that in recent years products have appeared which, even without containing tobacco, retain the full addictive potential of nicotine and raise relevant public health risks.
Motion focuses on authorized channels and protection of minors
The motion calls on the government, in cooperation with autonomous communities, public administrations, and public bodies within their areas of competence, to establish measures that limit the sale of vaping products, nicotine pouches, and other tobacco-related products to authorized channels under current regulations, excluding commercialization on the internet and in non-specialized shops.
It also calls for stronger control and supervision to ensure that distribution and sales are carried out only through authorized channels while guaranteeing traceability, taxation, and health and environmental compliance.
Popular Party supports tighter control but rejects an “absolute” online ban
Popular Party senator José Manuel Aranda Lassa said that the rise in underage use, the regulatory gap around nicotine pouches, and failures in controlling online sales make stronger regulation necessary.
He said the sale of nicotine delivery devices cannot remain in disordered and weakly controlled distribution circuits or be exposed to inappropriate commercial practices, and that the absolute priority is to prevent minors from accessing these products.
At the same time, he argued that regulation should go beyond an “absolute prohibition” on online sales and instead place online sales under a regime equivalent to in-person sales, including prior authorization and age verification.
The motion also addresses recycling, inspections, and the national addictions strategy
Beyond sales restrictions, the motion also calls for continued interministerial coordination, consideration of expanding collection and recycling programs for disposable vapes, evaluation of inspections of unregulated sales channels and non-specialized shops, and assessment of the economic and health impact of the measures to ensure proportionality and effectiveness. It also calls for these measures to be taken into account in the framework of the next National Strategy on Addictions.
