2ONE Labs and Performance Plus Marketing pay $1M bond for preliminary injunction in trademark dispute with ZONE.

According to Ein Presswire on January 2, the American nicotine pouch brand 2ONE Labs and distributor Performance Plus Marketing have paid a $1 million bond to the court in order to secure a preliminary injunction in their trademark dispute with the tobacco brand ZONE.

The deposit reflects our commitment to protecting the intellectual property of 2ONE, ensuring the brand's unrestricted expansion in the market without any hindrance from trademark infringers.


Vincent pointed out that the guarantee was made in accordance with a court order and is a crucial step in protecting the company's brand. It is intended to cover any potential losses that may occur if the injunction is overturned. Such legal requirements are common in trademark disputes, and the guarantee amount is much lower than the $50 million initially proposed by Imperial.


2ONE Labs and Performance Plus Marketing remain optimistic during this litigation phase, anticipating a favorable outcome to protect 2ONE's extensive trademark rights in the nicotine pouch product field.


On December 23rd, the American nicotine pouch brand 2ONE Labs announced on its official website that the brand had obtained a favorable preliminary injunction (PI) ruling in a trademark dispute with distributor Performance Plus Marketing over the Empire Tobacco brand ZONE. According to a court order dated December 20, 2024, ZONE nicotine pouches are prohibited from being shipped to trade partners in the United States. Australia’s Coalition has unveiled a national illicit-tobacco policy that would cut tobacco excise by 80% and create legal, regulated and taxed adult markets for vaping products and nicotine pouches if it wins government. The plan proposes an excise of A$0.50 per millilitre of e-liquid and A$0.025 per milligram of nicotine in pouches, alongside A$200 million in additional enforcement and a A$60 million three-year public-awareness campaign. The Coalition says the package would narrow the price advantage of illicit products and undermine organised crime, while Labor and public-health groups warn that dramatically cheaper cigarettes could reverse long-term declines in smoking.

IKE Tech launched IKE 2.0 on September 28, initially targeting nicotine products with a platform that combines user identity verification, product authentication, configurable policy controls and data analytics. Products can be authenticated through direct device integration or NFC smart tags. IKE Tech was formed with participation from Ispire's Aspire North America, Berify and Chemular, with Ispire currently holding a 40% interest. Its age-verification component PMTA was accepted by the FDA in 2025 and remains under review. The UAE Ministry of Finance will introduce a minimum excise price for e-liquids used in vaping and electronic smoking devices from September 1, 2026. The minimum excise price will be set at AED 1 per millilitre. The existing 100% excise tax rate will continue to apply to tobacco and electronic smoking products. The measure changes the minimum taxable base rather than the tax rate, with the UAE government saying it aims to establish unified tax standards, improve market compliance and prevent pricing loopholes.
