Kentucky House Bill Proposes Banning E-cigs Not Authorized by FDA

Kentucky House Bill 11 proposes stricter regulations on e-cigarette sales, requiring FDA-approved products to protect youth from potentially harmful options.

Recently, according to reports from US media WLKY, the Kentucky State House is pushing for a bill to impose stricter restrictions on the sale of e-cigarettes and e-cigarette retailers in Kentucky. Under House Bill 11, retailers can only sell smokeless nicotine products that have been certified by the US Food and Drug Administration (FDA).

A bill has been proposed to regulate e-cigarette and vaporizer products that have fruity flavors and bright packaging, which are clearly designed to appeal to teenagers. Representative Rebecca Raymer believes that many of these products are being sold on the market without approval.

Raymer stated, "The key is that it is Congress that grants the FDA the authority to regulate these products, not us, and that is a recognized provision. There is no doubt about this, but I know that the FDA's enforcement capability is very limited. Therefore, as a state, we have a duty to provide protection to the public. If we know that these goods have not been authorized by the FDA, then we cannot allow them to appear on the shelves."

HB11 has passed out of committee and is now awaiting consideration by the full House of Representatives.
