According to the report, the Congress of Coahuila has approved a ban on the sale, use and promotion of vapes and similar devices, citing their harmful effects on health and the environment.
Coahuila approved an amendment to Article 33 Bis that broadens restrictions on vape-related products
The initiative was introduced on March 2 by legislator María del Mar Treviño and seeks to amend Article 33 Bis of the state Law for the Protection of Non-Smokers in order to prohibit electronic nicotine delivery systems, non-nicotine devices, alternative consumption systems and e-cigarettes.
The approved text includes several forms of these products, such as e-cigs, vape pens, pods, mods, tank systems and heated tobacco products. It also restricts articles that are not tobacco products but use design elements or branding associated with such devices.
The measure cites the 2022 federal decree and says freedom of commerce is not absolute
The proposal draws on the federal decree published on May 31, 2022 in Mexico’s Official Gazette, which prohibits the circulation and commercialization of these products nationwide.
The reviewing commission said that the right to freedom of commerce is not absolute and may be limited when the rights of third parties are affected or when higher public interests must be protected.
Lawmakers said the products pose health and environmental risks and affect children’s interests
The commission said the use of these devices represents health risks for consumers and also affects the right to a healthy environment.
The approved text also states that these products generate pollution, may affect people around users, and undermine the best interests of children by encouraging the consumption of harmful substances.
