Proposal for Determining the Minimum Price of Nicotine Products
Russia's Ministry of Finance proposes setting a minimum price for nicotine products in circulation and sales within the country.

On August 11, according to a report by TASS, the Russian Ministry of Finance has put forward a proposal to determine the minimum price for the circulation and sale of nicotine products (excluding export to areas outside Russia and the Eurasian Economic Union). The draft government resolution for this proposal was drafted by the Ministry of Finance and published on a legal portal website.

According to the explanation, the method proposed has already been applied in the Ministry of Agriculture's formulation of the minimum prices for tobacco products.

Meanwhile, e-cigarette liquids and hookah tobacco mixtures that do not contain nicotine are currently exempt from tobacco taxation.

Therefore, in formulating the formula to determine the lowest prices of these products, the tax rates of similar products such as e-cigarette liquid and water pipe tobacco are utilized.

According to the report, the proposal outlines steps to determine the minimum prices of heated tobacco products, e-cigarette liquid (including nicotine e-liquid and non-nicotine e-liquid), and non-tobacco hookah tobacco mixtures. The formula in the draft is summarized as a general form, and its calculation method is as follows:

The lowest price is equal to the tax rate on unit quality or volume multiplied by (1 + value added tax rate) multiplied by an increase factor. In the given formula, the increase factor reflects the production cost or import cost of the product, as well as logistics and infrastructure maintenance expenses. When calculating these factors, data on the cost and purchase price of manufacturers and importers of the relevant types of products are also considered.

The document indicates that...

The increase coefficient in this formula reflects the production costs of a product or the procurement costs of an importer, as well as logistics and infrastructure maintenance costs. When calculating these coefficients, cost and procurement price data from manufacturers and importers of related types of products are also used.

The implementation of a minimum price will affect the illicit portion of the nicotine products market. However, it is worth noting that wholesalers and retailers who operate honestly have already been selling nicotine products at prices higher than the minimum price. Therefore, these businesses will not be affected by the resolution if it is passed.

As JUUL2 Wins FDA Authorization, Harm Reduction Journal Highlights the Role of Real-World Evidence in Nicotine Product Regulation
A commentary published in the international open-access, peer-reviewed Harm Reduction Journal argues that randomized controlled trials remain central to evaluating smoking cessation efficacy but cannot alone capture real-world uptake, complete switching, longer-term use and population impact of non-combustible nicotine products such as e-cigarettes, heated tobacco and nicotine pouches. The authors frame impact as “reach × efficacy” and call for real-world evidence to complement RCTs. Three days after publication, the FDA authorized three JUUL2 products and highlighted complete switching among adult smokers in explaining its decision, providing a timely regulatory backdrop to the debate.

New York’s 75% Wholesale Tax on Nicotine Pouches Takes Effect Sept. 1, With Aug. 31 Inventory Subject to Floor Tax
New York State will extend its tobacco products tax to “alternative nicotine products,” including tobacco-free nicotine pouches, from September 1, 2026, at a rate of 75% of the wholesale price. Distributors, wholesalers and retailers must also inventory products held as of 11:59 p.m. on August 31 and pay a floor tax. Vapor products are excluded from the new category and remain subject to New York's separate 20% supplemental sales tax on the retail price.

FDA Authorizes JUUL2, Cites Adult Switching Amid Efforts to Speed PMTA Reviews
The FDA authorized the JUUL2 device and tobacco- and menthol-flavored pods on Aug. 28, bringing the number of authorized e-cigarette products to 48. The agency highlighted complete switching among adult smokers, with six-week switching rates reaching 28.4%–49.3% for the menthol pod. The decision comes as FDA works to speed PMTA reviews, reduce application backlogs and expand authorized e-cigarette and nicotine-pouch products while maintaining enforcement priorities for unauthorized products.

India Duty-Free Nicotine Pouch Sales Face Regulatory Test as ZYN, FOX Classification Remains Open
The Bombay High Court has ruled that airport duty-free shops are not exempt from India's domestic regulatory laws merely because they operate beyond the customs barrier, leaving in place a sales halt covering ZYN and FOX nicotine pouches at Mumbai's international airport. The court, however, did not determine that the products necessarily qualify as "drugs" under India's Drugs and Cosmetics Act. The retailers have four weeks to submit product information to the appropriate authorities, including CDSCO, which must complete its review within 30 days of receiving the submissions.

Philip Morris Malaysia Again Meets Religious Authority Over Cigarette Alternatives as Perlis Mufti Responds on Halal Criteria
Philip Morris Malaysia Managing Director Naeem Shahab Khan met Perlis Mufti Mohd Asri Zainul Abidin on September 17 and presented the company's shift from conventional cigarettes toward alternative products. The mufti said a product could be considered halal if it is clean, its side effects are not harmful or can be controlled, and it does not involve excessive waste. His remarks did not mention IQOS or any other specific PMI product and did not amount to a new product-specific religious ruling. It was at least the second publicly reported engagement between Philip Morris Malaysia and a Malaysian religious institution over cigarette alternatives within six months.
