BIR to Begin Confiscation of Unmarked E-cigarette Products from 2024
Philippine tax bureau to seize e-cigarette products without tax stamps starting June 1, 2024, imposing fines and criminal charges.

According to a report from the Manila Bulletin on May 8, the Bureau of Internal Revenue (BIR) in the Philippines has announced that starting on June 1, 2024, they will begin confiscating e-cigarette products that do not have the required internal revenue stamps. Individuals and businesses found in possession of these illegal products will be held accountable and may face legal consequences.

 

Romeo D. Lumagui Jr., the director of the Bureau of Internal Revenue, recently issued a statement requiring e-cigarette manufacturers and importers to pay consumption taxes and comply with domestic tax stamp requirements by June 1 of this year. Starting on May 8, they can order the new generation of tax stamps.

 

The director warned that starting in June of this year, the BIR will strictly regulate the market and confiscate e-cigarette products that are not properly marked with tax stamps. Violators may face not only hefty fines (which can be increased to ten times the original amount) but also possible criminal charges for tax evasion.

South Korea's Constitutional Court has upheld fixed taxes on nicotine-containing e-cigarette liquids based on solution volume, ruling that challenged provisions imposing KRW 370 per milliliter in individual consumption tax and KRW 628 per milliliter in tobacco consumption tax do not violate the Constitution. The cases stemmed from historical disputes involving importers that reported nicotine as being extracted from tobacco stems rather than leaves. South Korea has since broadened its tobacco definition to include synthetic nicotine, while current tax laws provide reduced rates for certain products not derived from tobacco.

AIR Limited, a wholly owned subsidiary of AIR Global, has launched an offering of U.S. dollar-denominated senior unsecured notes, with proceeds primarily intended to repay its existing term loan and revolving credit facility. AIR has not disclosed the final size, maturity or coupon; Refinitiv, citing Moody's, reported an expected issuance of approximately $400 million and a Ba3 rating. AIR had about $412.4 million outstanding under the two bank facilities at June 30 and net debt of $344.8 million. In the first half of 2026, AIR's Al Fakher-led flavored shisha molasses business generated about 99% of company revenue, while New Growth Categories including Crown Switch produced $2.2 million in revenue and remained loss-making on an adjusted EBITDA basis.
