Growing Concerns Over Illicit Chinese E-cigarette Sales in America
Former ATF Deputy Director Rich Marianos discussed the rapid growth of e-cigarette devices in the US, especially from China, leading to illegal sales.

According to the report in the Florida Times on September 23, Rich Marianos, former deputy director of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF), discussed the rapid increase of e-cigarette devices in American communities, especially those from China. He believes that these devices have illegally entered the United States and infiltrated high school and college campuses.


He stated that in Florida, Chinese companies like RELX, Fume, and HQD accounted for 85% (a total of $355 million) of the state's total e-cigarette market value of $410 million in 2023. Additionally, e-cigarette sales in Florida were nine times higher than in New York. However, these brands have not received approval from the FDA.


Later, Marinos pointed out the inaction of the federal government in addressing this issue, specifically mentioning Dr. Brian King, director of the FDA Center for Tobacco Products. He also criticized Dr. King for his lack of understanding of the special task force addressing the issue of e-cigarettes. Marinos stated, "Americans should be better protected. At the national level, they have not taken any action against these e-cigarette shops.


According to reports, in June of this year, the Department of Justice and FDA announced the establishment of a federal multi-agency task force to curb the distribution and sale of illegal e-cigarettes. Dr. Brian King stated, "Enforcement against illegal e-cigarettes is a multifaceted issue that requires multifaceted solutions." He also noted that this "whole of government" approach, including the creation of new interagency task forces, will bring together the collective resources and expertise of the federal government to address this urgent public health issue.

Germany Probes 7.6 Million Illegal Vape Case With Estimated €33.3 Million Tax Loss; Four Chinese Manufacturer Employees Under Investigation, Some Packaging in Enforcement Images Resembles FUMOT Products
German prosecutors and customs authorities are conducting a criminal investigation into an alleged cross-border organised vape network. Authorities say that between January 2024 and March 2025, four employees of an unnamed Chinese e-cigarette manufacturer allegedly built a network of sales agents and wholesalers that brought more than 7.6 million nicotine disposable vapes into Germany, causing an estimated €33.3 million in excise-tax losses. The manufacturer has not been named. Some products visible in enforcement images have packaging resembling products from FUMOT’s portfolio. European regulatory records from 2024, FUMOT’s public overseas-sales materials and records involving German vape importer and distribution company Zamu-Pro GmbH also show FUMOT/RandM products and German distribution activity during the period covered by the investigation.

New York State will extend its tobacco products tax to “alternative nicotine products,” including tobacco-free nicotine pouches, from September 1, 2026, at a rate of 75% of the wholesale price. Distributors, wholesalers and retailers must also inventory products held as of 11:59 p.m. on August 31 and pay a floor tax. Vapor products are excluded from the new category and remain subject to New York's separate 20% supplemental sales tax on the retail price.

Russia will place e-cigarettes and related nicotine products under its “strategic goods” framework from August 20, 2026. According to TVP World’s report published on August 19, the newly listed items include e-cigarettes, electronic smoking devices, vape liquids and nicotine salts. Philip Morris International has published its first report aligned with the Taskforce on Nature-related Financial Disclosures, bringing its electronics supply chain and the use and end-of-life stages of smoke-free devices and consumables into its nature-related assessment. PMI said its smoke-free business accounted for about 42% of total net revenues in the second quarter of 2026. The report says non-circular electronic products, particularly single-use items, can increase consumption of limited natural resources and also details an IQOS repair pilot. A 2040 circularity scenario tests assumptions including a 50% reduction in product waste-related costs, 10% raw-material savings and a 25% substitution rate for refurbished products versus new products.
