Irish Government to Consider Ban on Disposable E-Cigarettes
Irish Cabinet to consider banning sale of disposable e-cigarettes amid concerns over public health and environmental impact.

According to a report by the Irish Times on September 10, the Irish government cabinet will consider a proposal to ban the sale of disposable e-cigarettes.


Health Minister Stephen Donnelly is expected to receive government approval to begin drafting legislation to ban the sale, manufacture, or import of disposable e-cigarettes in Ireland.


Donald plans to introduce this ban from the perspective of environmental protection and public health. The cabinet will consider a report pointing out that disposable e-cigarettes are relatively cheap and have a high usage rate among young people. Additionally, these products can cause harm to the environment if not disposed of properly, so their plastic and batteries should be recycled correctly.


Minister Donald expressed concern that the nicotine content in products sold in the country exceeded the allowable maximum level of 20 milligrams.


The legislation will also ban flavored nicotine products that appeal to children. It is estimated that there are up to 15,000 flavor combinations on the market. The law will prohibit advertising e-cigarette products outside of specialty stores and restrict colorful packaging. Donnelly will also update the Cabinet on future predictions for the number of general practitioners in Ireland over the next few years, expecting an increase from about 7 per 10,000 people to 9 to 10.

Mesa Underwriters Specialty Insurance Company has asked a federal court in Washington to declare that it has no duty to defend or indemnify vape distributor i5 Distribution in a product liability case involving an Elf Bar BC5000. The plaintiff alleges that the disposable vape caught fire and exploded in his pocket, causing severe burns and ultimately requiring an above-the-knee amputation of his left leg. MUSIC is relying on a tobacco, nicotine or nicotine replacement products exclusion and a premises limitation endorsement. The court has not ruled on the coverage dispute.

FDA Revises Import Alert 98-07 Rules, Bringing May Enforcement Priorities Into Unauthorized ENDS Detentions
The U.S. Food and Drug Administration has revised the rules under Import Alert 98-07 to incorporate its May 2026 enforcement-priority policy for certain electronic nicotine delivery systems marketed without premarket authorization. The alert continues to allow detention without physical examination, or DWPE, for ENDS lacking required marketing authorization, while directing field divisions to apply the May risk-based framework. When necessary, detention or refusal decisions must also undergo review by the FDA's Center for Tobacco Products. Products including PACHA and Vuse Pro have already emerged as industry examples of the May policy, although enforcement discretion does not constitute FDA marketing authorization.

South Korea's Constitutional Court has upheld fixed taxes on nicotine-containing e-cigarette liquids based on solution volume, ruling that challenged provisions imposing KRW 370 per milliliter in individual consumption tax and KRW 628 per milliliter in tobacco consumption tax do not violate the Constitution. The cases stemmed from historical disputes involving importers that reported nicotine as being extracted from tobacco stems rather than leaves. South Korea has since broadened its tobacco definition to include synthetic nicotine, while current tax laws provide reduced rates for certain products not derived from tobacco.

U.S. Military Could Test Nicotine Pouches and Vapes for Smoking Cessation as Washington Examiner Cites ZYN and Potential $4 Billion Reduction in Related Defense Costs
The House-passed FY2027 National Defense Authorization Act includes a provision authorizing the defense secretary to conduct a one-year smoking-cessation pilot for active-duty service members. Section 707 lists counseling, nicotine gum and patches alongside what the bill calls "electric nicotine delivery systems," nicotine pouches and heat-not-burn products. A recent Washington Examiner op-ed cited ZYN as an example in arguing for the provision, but the legislation does not name any commercial brand or supplier. ZYN is made by PMI-owned Swedish Match USA, with specified products holding FDA marketing authorizations and modified risk orders.

Philip Morris Japan (PMJ) has expanded the ZYN by IQOS oral tobacco pouch portfolio in Japan with four new ZYN Strong products, adding a third intensity level alongside the existing Low and Medium ranges. The Strong series first entered selected duty-free channels in Japan on July 1, 2026, before expanding to IQOS stores, the ZYN Online Store and selected tobacco retailers from August 18. The expansion increases the Japanese ZYN by IQOS lineup from eight to 12 products.
