Mexico officially bans production, sale, and distribution of e-cigarettes and vaping devices to safeguard public health.

According to See.News, on January 19th, Mexico officially banned the production, sale, and distribution of e-cigarettes and vaping devices. The law was signed by Mexican President Claudia Sheinbaum as an important measure to protect public health. The new law came into effect on January 18, 2025, and considers all activities related to e-cigarettes, vaping devices, and similar systems as criminal offenses.

The ban also prohibits the manufacturing, distribution, processing of harmful substances, as well as the unauthorized use of synthetic drugs such as fentanyl. This legislation overrides any conflicting administrative or regulatory provisions, ensuring nationwide implementation.

Sean Baum emphasized that this ban safeguards the health rights of all citizens. The legislation aligns with the amendments to Articles 4 and 5 of the Mexican Political Constitution overwhelmingly passed by the House of Representatives in December 2024.

The regulation requires Congress and federal legislative bodies to adjust the legal framework within a specified timeframe to comply with the new provisions. Congress has 180 days to update relevant laws, while federal entities must make necessary adjustments within one year, aiming to ensure consistent enforcement nationwide.

Former Health Minister and head of the Public Health Advisory Council of Harrisco State, Salomón Chertorivski, expressed concerns about the new law, stating that forcing manufacturers to disclose harmful chemicals in products may help consumers better understand risks. He warned that a complete ban could fuel the black market for e-cigarettes, potentially exacerbating public health risks due to the circulation of unregulated products.
