Mississippi House Considers Bill to Ban E-Cigarette Sales

Mississippi House of Representatives deliberated over 60 Senate bills this week, including a ban on e-cigarette sales.

According to the Enterprise-Tocsin on April 18th, the Mississippi House of Representatives this week reviewed over 60 Senate bills, including one concerning e-cigarettes.

Senate Bill 2441 will prohibit the sale of any alternative nicotine products, such as e-cigarettes or vaping products.

The bill amends section 97-32-51 of the 1972 Mississippi Code to prohibit the distribution, sale, or provision of any e-cigarette or electronic device capable of delivering ingestible nicotine, as well as any powder, component, liquid, capsule, or powder used to fill such e-cigarettes or electronic devices. An exception is made for any such products if the manufacturer has submitted a premarket tobacco product application that is still under review by the Food and Drug Administration.

The proposal introduces an amendment to establish the "2024 Mississippi Tobacco Harm Reduction Act." However, some have argued that the amendment is unrelated to the original legislation. After addressing procedural issues, the bill passed with a vote of 115 to 0 and has now been forwarded to the Department of Justice.
