Kentucky State Council Addresses E-Cigarette Regulations in March Session
Kentucky lawmakers are tackling various e-cigarette issues this month, including restrictions on which products retailers can sell.

According to a report from weku.org on March 24th, the Kentucky state legislature is currently addressing several issues related to e-cigarettes this month. One of them involves which e-cigarette products retailers are allowed to sell.

 

Bill SB 344 requires e-cigarette manufacturers to register with the state government, which will release a catalog of products that meet the standards.

 

At the committee hearing, some e-cigarette store owners expressed concerns about the upcoming state sales ordinance, believing it would overly restrict their businesses. Democratic Senator David Yates also voiced opposition to the measure.

 

Due to the possibility of situations arising, all places that comply with regulations and act in accordance with them... Yes... we will restrict those places. But, will we have personnel to enforce all places selling inferior products? So, what we really should do is focus on enforcement.

 

London Republican Senator Brandon Storm stated that many e-cigarette shops have been working hard to comply with any new sales requirements. With less than a week left until the ten-day override period, the senator hopes that the bill will be considered and passed in the House of Representatives.

 

Another bill concerns students using e-cigarettes at school.

FDA Revises Import Alert 98-07 Rules, Bringing May Enforcement Priorities Into Unauthorized ENDS Detentions
The U.S. Food and Drug Administration has revised the rules under Import Alert 98-07 to incorporate its May 2026 enforcement-priority policy for certain electronic nicotine delivery systems marketed without premarket authorization. The alert continues to allow detention without physical examination, or DWPE, for ENDS lacking required marketing authorization, while directing field divisions to apply the May risk-based framework. When necessary, detention or refusal decisions must also undergo review by the FDA's Center for Tobacco Products. Products including PACHA and Vuse Pro have already emerged as industry examples of the May policy, although enforcement discretion does not constitute FDA marketing authorization.

U.S. Ninth Circuit Upholds FDA Denial of MH Global’s Flavored Vape PMTA Applications
The U.S. Court of Appeals for the Ninth Circuit upheld the FDA’s denial of MH Global LLC’s applications to market flavored electronic nicotine delivery systems (ENDS). The court ruled that FDA’s comparative-efficacy framework, which requires applicants to show that flavored products provide greater cessation or switching benefits than tobacco-flavored alternatives, is consistent with the Tobacco Control Act’s “appropriate for the protection of the public health” standard. The court also found that FDA was not required to establish the framework through notice-and-comment rulemaking.

European Ombudswoman Teresa Anjinho has opened an inquiry into how the European Commission’s Directorate-General for Trade handles interactions with the tobacco industry. The case follows a complaint from a civil society organisation that alleges regular, unnecessary and non-transparent contacts between DG TRADE and tobacco industry representatives, raising questions over compliance with the EU’s obligations under the WHO Framework Convention on Tobacco Control. The inquiry remains ongoing, and the Ombudswoman has not reached any finding of maladministration.

After Apple Business Decline, South Korea’s ITM Semiconductor Expands KT&G Vape Supply Chain as Vape Revenue Rises 24.8%
South Korean electronics component supplier ITM Semiconductor is reshaping its business portfolio after a decline in Apple-related protection circuit business, expanding its supply of vape devices and cartridges to KT&G. According to News1 on August 18, 2026, ITM’s vape-related revenue rose 24.8% year on year to 75.5 billion won in the first half of 2026. The company began mass production of vape devices at its Cikarang, Indonesia facility in January 2026, strengthening export manufacturing capacity. Meanwhile, Samsung-related protection circuit sales continued to grow, providing support during the transition.
