Poland Proposes Ban on E-Cigarettes Sales to Minors Under 18
Poland's Health Ministry proposes a bill to ban e-cigarette sales to under 18s and restrict use in certain areas.

According to Bankier on January 14th, the Polish Ministry of Health has proposed a bill that plans to prohibit the sale of all types of e-cigarettes to individuals under the age of 18, and prohibit the use of e-cigarette products, including those without nicotine, in schools and children's playgrounds.


The bill proposes amending the Health Protection Act to prevent the negative impact of tobacco and its products. Specifically, it includes prohibiting the sale of any type of e-cigarette and spare e-liquid to minors, whether or not these products contain nicotine.


In addition, the bill plans to change the definition of "vaping" to include non-nicotine e-cigarettes, making it illegal to use them in public places such as schools, daycare centers, public transportation hubs, and children's playgrounds, where nicotine e-cigarettes are currently prohibited.


The draft also recommends prohibiting the sale of nicotine pouches to minors in places such as medical institutions, schools, educational institutions, sports and entertainment facilities, as well as vending machines and self-service systems. The bill also prohibits the remote sale of nicotine pouches, similar to regulations on the sale of smokeless tobacco products.


The bill plans to set a six-month transition period, with the revised bill taking effect 14 days after it is announced.


According to the Legislative Center website of the Polish government, an additional proposal from the Ministry of Health is currently under review, which plans to ban the sale of heated tobacco products with specific flavors. The bill includes updates to the definition of "heated tobacco products.
